General conditions of Sales Olive & Bio

 

The online shop of web sites www.oliveandbio.com and to www.ciguenanegra.fr was organized by the company Olive & Bio, registered in the RCS of Nanterre (France) Under Number 532003498 and carrying Number Intracommunity VAT FR54532003498, which is the developer of these sites.

The present terms of sale aim at defining the contractual relations between Olive and Bio and the professional or particular Buyer, who would make a purchase by means of the retail website of Olive & Bio and the applicable conditions within the framework of this purchase.

These terms of sale will prevail over quite other general or particular conditions not expressly approved by Olive & Bio.

Olive and Bio reserves the right to be able to modify its terms of sale at any time. In that case, the applicable conditions will be the ones current in the date of command by the Buyer.

It is called back that any purchase is supposed to be only made in purposes of use or consumption of our products; the resale of products bought on the Internet is formally forbidden but we stay in the arrangement of the Professionals who would like to receive a specific offer to distribute products Ciguena Negra.

PRICES :

The prices are indicated in euro inclusive of all taxes and take into account the applicable VAT in the day of the command. Any change of the rate can be echoed on the price of products. Price lists do not include the expenses of delivery, charged in supplement, indicated before the validation of the command.

Price lists are established from 02/05/2011 till 31/12/2011. To note however that Olive & Bio reserves the right to modify both the prices and its commercial policy at any time, being included that the price appearing in the catalog the day of the command will be the only one applicable to the Buyer.

 

AVAILABILITY :

Products proposed in the sale are the ones which appear in the catalog published on the site of Olive & Bio. The photos of the catalog are the most faithful possible but cannot insure a resemblance completed with the sold product, in particular as regards colors.

Products are proposed while stocks last.

If commanded articles are inalienable, Olive & Bio will inform the Buyer about it by email or by telephone as soon as possible and will propose him(her) a secondary solution to supply him(her) an article of quality and equivalent price.

However, if he does not wish to accept this proposition, the Buyer can cancel his command and be paid off by Olive & Bio.

 

DELIVERY :

The delivery is made by post in Colissimo followed, put back  against firm.

A delivery by carrier in 24 hours is only proposed on Metropolitan France; this mode of faster delivery is an option which causes an additional cost.

 

- In case of mail delivery, the parcel is put back against firm and in case of absence, it is put deposited in the closest post office.

- In case of delivery by carrier, this last one contacts the Buyer by telephone or by e-mail to agree  on a meeting in its place of residence to put back to  him(her) the parcel against firm.

- For other countries, the transport is made according to the agreements of The Post office with their persons receiving benefits in the concerned country. The parcel is put back against firm.

 

Postal charges :

For metropolitan France, postal charges are calculated at fixed rate according to the number of articles commanded on the basis of the following prices  (in €, Inclusive of all taxes of which VAT 19,6%)

Delivery deadline :

For the deliveries in France, Corsica and Monaco, the average delivery deadline is from 2 to 4 Working days as from the confirmation of payment; the maximal deadline  to which Olive & Bio makes a commitment to deliver is of 15 days.

For the deliveries in the other countries, the average delivery deadline is from 4 to 10 working days according to the destinations; the deadline to which Olive & Bio makes a commitment to deliver is of month as from the confirmation of payment.

For the deliveries made by carrier (exclusively on the Paris region), the average delivery deadline is of 24 hours ; the deadline to which Olive & Bio makes a commitment to deliver is of 72 hours.

 

In case of damage :

The Buyer is anxious to verify from their arrival the state of the parcel and the packaging of the goods.

He will have to note his reserves on the documents of the carrier or the Post office, refuse the delivery, and to inform about it Olive & Bio by mail. This procedure is compulsory so that the commanded article is exchanged or paid off, as well as the expenses of return as soon as possible.

Any complaint must be formulated within 2 working days maximum; beyond this deadline, any complaint will be thrown back.

Any complaint not made in rules above and within the time limits allowed cannot be taken into account and will loosen  the company Olive & Bio of any responsibility face to face of the consumer.

 

Responsibility:

Olive and Bio insures the goods up to the place of delivery but cannot be nevertheless held for responsible of an impossibility of delivery independent from its will (absence, error of description in the address, etc.).

Olive & Bio recommends consequently to the Buyer to watch the exactness of delivery addresses.

Any indistinctness can pull an important delay and an additional cost which will be echoed to him(her).

Olive & Bio declines any responsibility as for the extension of delivery deadlines because of the carrier, in particular in case of loss of products. Any delay due to major cases of strength (burden, bad weather…).

 

PAYMENT :

The Buyer can make his payments by credit card, by check, by bank transfer or by Paypal.

Payment by check: it is possible only for checks in euro pulled at a bank taken up residence in France. It is necessary to join to it the reference of the command to make the link with the payment and optimize the deadline of treatment of the command. The command  will be treated only in reception of this one. The stake in the collection of the check is realized in the reception of the check and the delivery deadlines are applicable from the reception of the check. Credit card payment: the transaction and the payment are secured.

The exchanges of data during the seizure of the number of bank card of the Buyer are coded thanks to the protocol SSL and never Olive & Bio has access to this information. The payment card is sold during the validation of payment with the center of payment secured Cybermut who sends to the Buyer an email of confirmation of payment.

Payment by bank transfer: the payment can be made by bank transfer.

The command will be treated only in reception of this one and the delivery deadlines are applicable from the date of reception of the transfer on the bank account bio of which Olive & Bio is the holder. It is necessary to join to it the reference of the command to make the link  with the payment and optimize the deadline of treatment of the command.

Payment by Paypal: the payment can be made by Paypal and the deal is secured and coded in SSL. The account Paypal is sold during the validation of payment which sends to the Buyer an email of confirmation of payment

Olive & Bio reminds to its clientele that the goods stay its whole property up to their complete payment. The payment of the totality of the price must be realized during the command so that this last one is taken into account. At no time the paid sums cannot be considered as deposit or deposits.

 

Olive & Bio reserves the right to suspend any management of command and any delivery in case of refusal of authorization of credit card payment on behalf of the officially accredited bodies or in case of not payment.

Olive & Bio also reserves the right to refuse to make a delivery or to honor a command emanating from a Buyer who would not have settled totally or partially a previous command or with whom a dispute of payment would be in the course of administration.

 

Exchange or refund: for an exchange or a refund, the Buyer has a deadline of 7 days as from the date of reception to return to Olive & Bio the intact products in their original packings, accompanied with an explanatory mail. It is however necessary to prevent beforehand of the dismissal of the parcel. The expenses of return will be responsible for the Buyer and not refundable.

Any request not made in rules above and within the time limit allowed will be thrown rejected and will loosen Olive & Bio of any responsibility.

 

Disputes: the sale contract is governed by the French law, Any contestings relative to the interprétation or to the non-fulfillment of the aforementioned contract will be the exclusive skill of the Commercial court of Nanterre (92, France). Only this court is competent for the resolution of any dispute. According to data protection acts of January 6th, 1978, the Buyer has a right of access and a rectification to the data concerning him. By the through of Olive & Bio, the Buyer can be brought to receive propositions of the other companies or the bodies among its partners, or to be also informed about offers by telephone, mail or email. If the Buyer does not wish it, he just has to write (letter or e-mail) by indicating his name, first name, address and Number of customer. He will have to proceed in the same way if he does not wish to receive any more from commercial propositions.
